NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. OPEN ONLY TO LEGAL RESIDENTS OF THE UNITED STATES AND THE DISTRICT OF COLUMBIA WHO ARE AT LEAST THIRTEEN (13) YEARS OLD AT TIME OF ENTRY. VOID WHERE PROHIBITED.
ELIGIBILITY
The Burger 21 “Burger 21 Survey Free Burgers for a Year Sweepstakes” (the “Sweepstakes”) is open only to legal residents of the United States and the District of Columbia who are at least thirteen (13) years old at the time of entry. Employees of Scratch Concepts LLC., dba/ Burger 21 (“Sponsor”) and their respective parent and affiliate companies, suppliers as well as the immediate family (spouse, parents, siblings and children) and household members of each such employee are not eligible. The Sweepstakes is subject to all applicable federal, state and local laws and regulations and is void where prohibited. Participation constitutes entrant’s full and unconditional agreement to these Official Rules and Sponsor’s and Sponsor’s decisions, which are final and binding in all matters related to the Sweepstakes. Receiving an entry is contingent upon fulfilling all requirements set forth herein. All entrants who are considered a minor in their state of residence must have his/her parent’s or legal guardian’s permission to participate in this Sweepstakes.
TIMING
The Sweepstakes period begins on January 1, 2024 at 10:45 a.m. Eastern Daylight Time (“EDT”) and ends at 11:59 p.m. EDT on January 31, 2025 (the “Sweepstakes Period”). The Sweepstakes consists of monthly drawings (“Monthly Drawings”) for thirteen (13) separate monthly entry periods (each, an “Entry Period”). Each Monthly Drawing will be conducted among all eligible entries in accordance with the Random Drawing Schedule in Section 5 below.
HOW TO ENTER
During the Sweepstakes Period, a receipt for the purchase of food or beverage at a participating Burger 21 restaurant will provide a link to a survey where you will be asked to evaluate your Burger 21 restaurant experience. To start your survey, visit the website printed on your register receipt within two (2) weeks after your visit, and follow the instructions to complete the survey. LIMIT: one (1) entry per 90 day period, regardless of the number of purchases made. If you do not have your receipt, you may still visit the website and input the store, date and time you visited to take your survey and be entered for a chance to win.
To enter without making a purchase: If you wish to enter without a purchase, please email marketing@burger21.com with FREE BURGERS FOR A YEAR and your closest Burger 21 location in the subject line to be automatically entered . LIMIT: one (1) entry per 90 day period, regardless of the number of purchases made. There is a limit of one (1) entry per person, per 90 day period regardless of method of entry.
DRAWINGS
Sponsor will conduct one (1) random drawing per Entry Period from among all eligible entries received by each of the Drawing Dates set forth below. Each entry is eligible only for the Monthly Drawing for the Entry Period during which the entry is received by Sponsor. Entries will not rollover to the next Entry Period. Sponsor is an independent judging organization whose decision about eligibility is final. Entries generated by any means inconsistent with the terms of these Official Rules or which, as determined by Sponsor, Sponsor or their staff (the “Sweepstakes Entities”) in their discretion, contravene the spirit of the entry process described herein, will be void and ineligible for the random drawing. Odds of winning a prize depend upon the number of eligible entries received during the applicable Entry Period. All prizes will be awarded provided a sufficient number of qualified eligible entries are received for each Entry Period, as outlined in the Drawing Schedule.

PRIZES
Twelve (12) Prizes, one (1) per each Monthly Drawing: Burger 21 Burgers for a Year awarded through the Burger 21 app, in form of Twelve (12) Burger 21 Burgers for a Year Vouchers (up to a value of $13.99 each voucher) to be redeemed at any participating Burger 21 Restaurant. To receive prizes, chosen winners must download the Burger 21 “Patty Perks” app (“App”) to claim their digital Burgers for a Year vouchers. The App is free but subject to the listed terms and conditions described within the App. Standard data charges may apply; see carrier for details. Terms and conditions of the Burgers for a Year vouchers will apply. Approximate Retail Value (ARV) of $167.88 each prize. The total aggregate value of all prizes will be approximately $2014.56. Prize cannot be substituted, assigned, or transferred; except at Sponsor’s sole discretion or as otherwise provided herein. Winner may make no substitution or transfer of prize and prize is not exchangeable for cash. The prize Winners are solely responsible for all applicable federal, state and local taxes and any expenses relating to the acceptance and use of the prize not otherwise specified herein. The Winners shall bear all risk of loss or damage to their prize after it has been delivered. Sponsor will not replace prize that is lost, stolen, or misdirected. The prize will be awarded “as is” without warranty of any kind, either expressed or implied, including but not limited to, the implied warranties of merchantability and fitness for a particular purpose. Sponsor reserves the right to substitute a prize with one of comparable use should the advertised prize become unavailable for any reason. By accepting a prize, Winners acknowledge compliance with these Official Rules. If a minor, prize will be awarded in name of parent/legal guardian.
WINNER NOTIFICATION
Sponsor will notify all potential selected winners within approximately five (5) days after the applicable Drawing Date by email only. If the potential winner does not respond to the email within three (3) business days of the email message, the prize is forfeited and an alternate winner will be chosen provided there are a sufficient number of qualified entrants. Upon forfeiture, no compensation will be given. The potential winner may be required to complete, sign and return an “Affidavit of Eligibility and Release” including, where legally permissible, a Publicity Release, within seven (7) days of date receipt of the Release document. If the potential winner is younger than 21 years of age or a minor under the law of his/her jurisdiction of residence (residents of Alabama and Nebraska must be 19 years of age or older and residents of Mississippi must be at least 21) at the time of entry, his or her respective parent or guardian may be required to execute an Affidavit acknowledging, confirming and consenting to the Release document in order to accept the prize on behalf of the winner. If parent or guardian is unavailable to execute this document, the winner will not receive the prize. Failure to complete and return the documents in the time noted or if prize notification is undeliverable will result in disqualification.
CONDUCT
This Sweepstakes is subject to all federal, state and local laws/regulations. By entering this Sweepstakes, entrants agree to be bound by these Official Rules and the decisions of the Sponsor that shall be final and binding in all respects. Sponsor reserves the right at its sole discretion to disqualify any individual suspected of (i) tampering with the entry process or the operation of the Sweepstakes; or (ii) to be acting in any manner deemed by Sponsor to be in violation of the Official Rules; or (iii) to be acting in any manner deemed by Sponsor to be unsportsmanlike or disruptive, or with intent to annoy, abuse, threaten or harass any other person; or (iv) to be behaving in any manner that Sponsor determines may place Burger 21, its affiliates or their respective agents and employees in danger of violating any provision of applicable law, or in danger of bodily injury or property damage, or that reflects adversely on Burger 21, its affiliates or their respective agents and employees. Any individual who attempts to enter, or in the sole discretion of Sponsor is suspected of submitting entries in excess of the disclosed maximum, by any means, including but not limited to establishing multiple email accounts will be disqualified from participation in this Sweepstakes. Automated and/or repetitive electronic submission of entries (including but not limited to entries made using any script, macro, bot or Sweepstakes service) will be disqualified and transmissions from these or related email or IP addresses may be blocked. CAUTION: ANY ATTEMPT BY A USER OR ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND COSTS (INCLUDING WITHOUT LIMITATION, ATTORNEYS’ FEES) FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. SPONSOR’S FAILURE TO ENFORCE ANY TERM OF THESE OFFICIAL RULES SHALL NOT CONSTITUTE A WAIVER OF THAT OR ANY OTHER PROVISION. Multiple entrants are not permitted to share the same email accounts. In the event of a dispute as to any entry, the authorized account holder of the email address, used to enter will be deemed to be the entrant. The “authorized account holder” of an email address, is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. Potential winner may be required to show proof of being the authorized account holder. If more than one person is shown as a responsible party, then the first-named person will be deemed the Authorized Account Holder unless the individuals on the account otherwise agree. Sponsor’s determination of the winner in case of a dispute will be final and binding. It is the sole responsibility of the entrant to notify the Sponsor in writing if the entrant changes his or her email address during the Sweepstakes Period.
ENTRANT RELEASES
All entrants, as a condition of entry into the Sweepstakes, agree to release Sponsor and Sponsor and each of their respective parent, subsidiary and affiliated companies, distributors, suppliers, printers, application developers, advertising, promotional and judging agencies or other persons engaged in the development, production or distribution of materials for this Sweepstakes (collectively “Released Parties”), from and against any and all liability, claims or actions of any kind whatsoever for injuries, damages, or losses to persons or property which may be sustained in connection with submitting an entry or otherwise participating in any aspect of the Sweepstakes; the receipt, ownership, use, misuse or non-use of prize awarded; preparing for, participating in or traveling to and/or from any prize-related activity, or any human, typographical or other inadvertent error in these Official Rules or the announcement of offering of prize. Sponsor makes no representations or warranties of any kind concerning the appearance, safety, or performance of prize. In the event there is a discrepancy or inconsistency between statements contained in any Sweepstakes-related materials, and terms and conditions stated in the Official Rules, the Official Rules shall prevail, govern and control and the discrepancy will be resolved in Sponsor’s sole and absolute discretion.
PUBLICITY
Except where prohibited by law, participation in the Sweepstakes constitutes each entrant’s consent to Sponsor’s and its agents’ use of recipient’s name, likeness, photograph, voice, opinions, and/or hometown and state for promotional purposes in any media, worldwide, without further notice, payment or consideration.
LIMITATIONS OF LIABILITY
Sweepstakes Entities, assume no responsibility or liability for (a) any incorrect or inaccurate entry information, or for any faulty, failed, garbled or jumbled electronic data transmissions; (b) any unauthorized access to, or theft, destruction or alteration of entries at any point in the operation of this Sweepstakes; (c) any technical malfunction, failure, error, omission, interruption, deletion, defect, delay in operation or communications line failure, regardless of cause, with regard to any equipment, systems, networks, lines, satellites, servers, computers or providers utilized in any aspect of the operation of the Sweepstakes; (d) inaccessibility or unavailability of the Internet or any combination thereof, or; (e) any injury or damage to participant’s or to any other person’s electronic device which may be related to or resulting from any attempt to participate in the Sweepstakes or download any materials in the Sweepstakes. If, for any reason, the Sweepstakes is not capable of running as planned for reasons which may include without limitation, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which may corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstakes, then Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Sweepstakes in whole or in part, and hold a random drawing for the prize from among all non-suspect eligible entries received as of the termination date. The Sponsor will not be responsible for acts of God, dangerous weather conditions, acts of terrorism, civil disturbances, work stoppage or any other matters beyond the Sponsor’s reasonable control (each a “Force Majeure” event) that may cause the cancellation or postponement of the Sweepstakes. These Official Rules will also be translated into Spanish. If there is any discrepancy in the interpretation between the original English language version and Spanish version of these Official Rules, the English language version will control and govern.
No more than the stated number of prizes will be awarded. In the event that technical, programming or any other reasons cause more than the stated number of prizes as set forth in these Official Rules to be available and/or claimed, Sponsor reserves the right to award only the stated number by a random drawing among all legitimate, un-awarded, eligible claims.
GENERAL CONDITIONS
By participating in this Sweepstakes, the entrant agrees to be bound by the Official Rules of this Sweepstakes and the decisions of the judges. The Released Parties are not responsible for: illegible, duplicate, incorrect or incomplete Codes or register receipts that do not contain Codes; lost, late, stolen, damaged, postage-due, undeliverable or misdirected entries, mail, email or other communications; technical malfunctions, errors in the published rules, including without limitation, errors which may occur in connection with the administration of the Sweepstakes, the processing of entries, the announcement of prize; or other paperwork to be processed that is lost, misdirected, delayed, undecipherable, interrupted, or transmitted late or incorrectly for any reason, including any equipment, systems, networks, lines, satellites, servers, computer, telephone, paper transfer, or human error or electronic, computer, or telephonic malfunction or error. All materials submitted become the sole property of the Sponsor and will not be returned. The Affidavit/Release Forms are subject to verification by the Sponsor. The awarding of the prize is contingent on individual’s full compliance with these Official Rules, as determined by the Sponsor in its sole discretion. If winner is found to have falsified any data or material, the winner forfeits his/her prize and is disqualified, and an alternate potential winner will be selected according to the original winner selection method. If prize notification is undeliverable or if potential winner does not comply within the applicable time period as stated in these Official Rules, he/she will be disqualified and an alternate winner would be selected. Acceptance of prize constitutes permission of the winner to allow Sponsor and its agencies to use winner’s name, comments, city, state, photograph, voice and/or likeness for purposes of advertising, trade and/or publicity without further compensation in all media now known or hereafter discovered, worldwide and on the World Wide Web, without notice, review or approval, unless prohibited by law.
DISPUTE RESOLUTION
Entrants (and each minor entrant’s parent(s) or legal guardian(s) agree that: (i) all items, products, and services are provided “as is” without warranty of any kind, either express or implied, including but not limited to, the implied warranties of merchantability, fitness for a particular purpose, or non-infringement; (ii) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for Florida or the appropriate Florida State Court; (iii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes but in no event attorneys’ fees; and (iv) under no circumstances will entrant (and each minor entrant’s parent(s) or legal guardian(s) be permitted to obtain awards for and entrant (and each minor entrant’s parent(s) or legal guardian(s) hereby waives all rights to claim punitive, incidental and/or consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. Some jurisdictions may not allow the limitation or exclusion of liability for incidental and consequential damages or exclusion of implied warranties, so some of the above limitations or exclusions may not apply to certain participants. Check local laws for any restrictions or limitations regarding these limitations or exclusions. California Residents: By participating in this Sweepstakes, you waive your rights with respect to California Civil Code section 1542, which states that “A General Release does not extend to claims which the creditor does not know or suspect to exist in his favor at the time of executing the Release, which, if known by him must have materially affected his settlement with the debtor”.
PRIVACY POLICY
Any personal information collected in conjunction with this Sweepstakes will be subject to Sponsor’s privacy policy posted at Burger 21.com/privacy-policy. In the event of a direct conflict between the privacy policy and these Official Rules, the privacy policy shall control and govern.
